General terms and conditions
1. General

The following conditions for use apply to the contract between the Jürgen Lind, Michael Karas and Lars Orta GbR - Internetservices, Hohenzollernstr. 41, 80801 München (in the following known also as invitem.net) and the users of services offered by invitem.net. By registering and using invitem.net services the user accepts the following conditions for use. Should the user not or no longer accept the following conditions he must cease using invitem.net's services immediately. The conditions for use are not only available online but can also be downloaded or printed out. If the user is unable to download or print the conditions for use they can also be obtained from the address above.

Use of invitem.net services is free unless otherwise specified in the conditions for use. invitem.net reserves the right to change products or services which are available free of charge.
invitem.net is using the Google App Engine(TM) as execution platform, therefore the servers are located in the United States of America (USA).


2. Membership and registration

A one-time and free registration is necessary to make use of the entire range of invitem.net services. The user can also gain an impression of invitem.net without registering; with a limited number of services available. Registration requires entering a valid email contact address and an individual password. This data is stored in accordance with data protection regulations and not passed on to third parties.

Further information and explanations about data collection and data protection are to be found in the data protection declaration which is an essential part of these conditions for use but which for reasons of clarity have been placed at the end of this document. Please read the data protection declaration carefully before registration since by registering you give your consent to data collection, data storage and data use as detailed in the data protection declaration.


3. invitem.net services

invitem.net acts as a leisure and business service which makes practical software available to the user free of charge. Some of invitem.net's services are set out below. invitem.net reserves the right to change or extend both the content and the user interface of this offer and to partially or completely block access to individual services as made necessary by maintenance work and/or further development of services. invitem.net also reserves the right to limit, cancel or charge a fee for services presently offered free without prior notice.

Personal account
The user receives a personal account with functions such as a personal address book, a module for creating and managing events and an overview of events which he either previously initiated using invitem.net's services or to which he was invited.

Sending email
invitem.net offers the user the service of sending emails. invitem.net reserves the right to refuse to send emails for commercial purposes or in large quantities (more than 100 recipients per action) without reason.

Links to other providers
If invitem.net offers links to other online services and the user takes advantage of these offers, then the user enters into an agreement solely with the respective service. invitem.net is in this case _ comparable with a telephone company _ simply the mediator and not responsible for third party content or arrangement of contracts.


4. User's obligations

The user is required to
(1) enter the information required for registration accurately and truthfully;
(2) treat his password as confidential and take care that it does not become known to a third party without permission;
(3) to co-operate in the investigation of attacks on the provider's system by third parties where such co-operation is necessary and reasonable;
(4) not to communicate content damaging to the rights of third parties in any form whatsoever;
(5) not to distribute illegal content with the help of invitem.net.



5. Warranty limitations

invitem.net does not guarantee that its services will be offered to the user without interruption and free from errors or that they are suitable for a particular purpose.
If the user enters into agreements with websites linked to invitem.net then these contracts are created exclusively with third parties (including co-operation and trading partners). invitem.net cannot take on any guarantee for these providers' services.


6. Limitations of liability

invitem.net accepts liability only for intentional and gross negligence; for slight negligence only if significant contractual obligations are not met. The size of claims for damages is limited to the value of foreseeable damage.

In as far as invitem.net guarantees access to databases or third party services invitem.net accepts no liability for the contents or safety of these databases or services nor for the correctness, completeness or freedom from third party claims of the content in regard to data, information and programs downloaded by the user.

The same logically applies if the database communication runs via third party networks such those of the Telekom AG. invitem.net accepts liability for the sending of but not for the arrival of SMS messages/emails sent via invitem.net.

invitem.net accepts liability for third party content which affects the rights of third parties only if it was positively aware of it in advance and sufficient time to react was given to invitem.net. If a user becomes aware of any such content invitem.net asks that it be informed immediately so that invitem.net can check whether it is possible or necessary to take legal action.


7. Cancellation of membership

The user can give notice of cancellation of his membership at any time in writing and / or electronically to the address mentioned under point 1.

invitem.net reserves the right to give one month's notice by means of a cancellation letter or also in electronic form to the address entered during registration. invitem.net should be informed immediately of any changes in this address.

This does not affect the right to cancel membership on extraordinary grounds. Amongst other things invitem.net regards actions by which the user passes on material unsuitable for young people or extreme left or right-wing or illegal content as grounds for cancellation of membership without notice. Attacks by the user on invitem.net services or on other users, for example by sending junk emails, flaming, spamming, cross-posting or the spying out of third party data can also be grounds for cancellation without notice.
Users who give cause for such an extraordinary cancellation can be placed on a _blacklist_ by invitem.net with the result that they can no longer use invitem.net's services and can also receive no more messages via invitem.net from then on.
On termination of membership all stored user data no longer required for billing or other purposes will be deleted unless the user does not wish this.

8. Change in conditions for use

invitem.net reserves the right to alter these conditions for use as long as the changes are reasonable taking into account the users' interests. invitem.net will inform customers of such changes by email before the alterations take effect. The user has a period of one month to object to such a change. In the case of objections being raised invitem.net reserves the right to give notice of cancellation of membership.


9. Conclusion

Should individual regulations amongst these conditions for use be or become invalid this does not affect the validity of the rest of this agreement.

Membership is subject to German law with the exclusion of UN sales law. Place of jurisdiction is agreed as Munich as far as the user is a businessman or has no general place of jurisdiction within Germany.
